Article 1 Section 10 of the US Constitution states that no state can use an ex post facto law in criminal court cases and that is what exactly what happen here. An ex post facto law is a law that is retroactive. Judge Merchan in his order dated 15 February 2024 stated that the executive orders extending time limitations for criminal prosecutions were legal in Section IV which begins on page 22. Trump's lawyers stated that the time limitations for the laws already happen but didn't mention that according to the US Constitution and US Supreme Court rulings such as Calder v Bull 3 US 386 and Miller v Florida 482 US 423 any criminal law that allows for ex post facto events happening is illegal under the Constitution of the US. Both of these cases stated that laws changing the sentencing of an illegal action that happened in the past is illegal. Under the old law Trump would not have been charged and thus had no sentencing or conviction. The so-called criminal actions happen under old law which meant he could not be tried in the time frame allowed by new executive law.
