During the pandemic Governor Walz made questionable decisions regarding capacities. Walz determined in a May 13, 2020, executive order that retailers would be allowed to reopen at 50% capacity, but he left religious gatherings capped at 10 people. After Catholic and Lutheran churches in Minnesota announced plans to resume meeting in person regardless of the governor’s order, he negotiated to allow religious groups to operate at 25% capacity, according to the Star Tribune. This of course was still unacceptable and directly infringed on religious rights so a lawsuit was filed since he didn't want to back down. You could have up to 50 people in a bar/restaurant but having more than 10 people in a church was not safe I guess. Despite his best attempt the lawsuit was NOT entirely dismissed. Qualified immunity was dismissed so Walz couldnt be directly liable but the bulk of the rights like freedom of assembly and free exercise of faith being remained in the lawsuit Prior to trial a settlement was reached and the churches won and were allowed to have full capacity. The was extremely important as this was the first time Governor Walz didn't have a case dismissed during the pandemic while issuing executive orders. 2. Last year in 2023 a bill was passed that prevented churches from denying people jobs who do not align with their traditional beliefs on gender. They could still attend just couldn't work there if the church didnt want them. Whether you agree or don't it has always been an exemption except on this bill. This opens up the church for liability as they have standards, morals, beliefs etc. When pressured by Cathlics, Lutherans, Jews, Muslims etc.. Democrats double downed and refused to add the exemption. In May of 2023 Democrats folded against the pressure of what would have been another loss in the courts and added the exemption. Governor Walz reluctantly signed it into law. I say reluctantly because if he wanted it done it would have been done earlier in the session no questions asked. The supreme court has already ruled on similar cases regarding churches and religious school hiring who they want and agree with There is also another lawsuit involved in 2023 against a law Governor Walz signed. The law amends the state’s Post-Secondary Enrollment Options (PSEO) eligibility rules to exclude Christian colleges and universities such as Northwestern and Crown due to their requirement of a statement of faith from students who attend on campus. The statements simply ask students to affirm the schools’ religious beliefs for the purpose of upholding their Christian communities. We will see how this one develops. One thing is clear...Democrats including Governor Walz made it obvious that religious freedoms take a back seat to the state’s rule, and the separation of church and state no longer exists in Minnesota.
