The reason is that there is NOT a lot of things Cohen has said that Trump disputes
is false. Trump ADMITS Cohen entered into the NDA with Daniels on Trump's behalf
1 week before the election, Cohen used his own money to pay Daniels $130,000, and
then Trump reimbursed Cohen starting in Feb 2017 by paying him a monthly retainer
fee of $35,000 per month.
The MAIN dispute between them is WHY Trump wanted to shut up Daniels,. Cohen
says Trump paid Daniels to help win the election. Trump claims he did it to protect
himself and his family from the embarrassment the allegations of Daniels would
cause them. But unless Trump testifies, it will be hard for Trump's lawyers to prove
this. Or refute Cohen. Because ONLY Trump can say with certainty what his reason
was for entering into the NDA with Daniels, And there is almost no chance Trump
will testify.
The SECONDARY dispute concerns the way Cohen was reimbursed by Trump.
Cohen claims the monthly retainer payments were disguised reimbursement for
Cohen's payment to Daniels. While Trump has made contradictory statements,
suggesting on some occasions he was unaware of this, and on other
occasions saying that at least part of the monthly payments to Cohen was
reimbursement for his payment to Daniels.
If anyone disagrees with my assessment, I would like to hear it.
