It's not a partisan perspective to have an extremely dim view of this ruling. The problem with this country is that in 2024, you're a republican or a democrat first and an American second. If you could temper your glee due to a favorable outcome for your candidate in this moment and consider the long term implications of this ruling for the health of our republic, you would consider this deeply unsettling. I couldn't like a candidate enough to be OK with this. You can believe that it is only a matter of time before a president you don't like, and who lacks the restraint to avoid utilizing such broad powers takes office. We have a hard time believing it could happen because we've not seen heinous, blood soaked abuses of unchecked power in our country. I assure you it can happen. Yeah, I'm a lawyer and I don't think people are realizing just HOW insane this ruling is because the reporting has been bad and there is only this talk about official vs. unofficial. People keep missing that the Supreme Court actually drew a distinction between 3 different acts: 1) acts under constitutional authority, which are absolutely immune no matter what; 2) official acts, which are presumptively immune, and any evidence related to them is inadmissible; 3) unofficial, no immunity. More importantly, you can't consider the motive or reasons behind the act according to them, you evaluate the act in a vacuum to see which it falls under.
So his discussions with the DOJ, which they said fell under his constitutional authority, were absolutely immune, even though they were discussions meant to further a criminal conspiracy to steal the election. They literally said it doesn't matter if the president is abusing their power or even committing a crime with that power, they have it, they can do whatever they want with.
Well, the president is the commander-in-chief and has constitutional authority over the military. So if he wants to use the military to do something, it's absolutely immune, regardless of what it is. The way their opinion is written, both deploying the military to help an ally in a war against our foreign enemies is just as immune from prosecution as dispatching a special ops force to assassinate the 6 SCOTUS judges. They're the ones who told us we can only look at the act, and not the reasons or consequences. In a vacuum, he's simply directing the military to do SOMETHING. That something cannot be considered.

So are conservatives actually comfortable with this broad interpretation of executive immunity? All presidents from both sides in modern history have weathered attempts to hold them legally liable for actions taken in office. A lot of those attempts would no longer be held valid, and even in cases where theyβre centered around actions taken before the presidency the president can use ALL of the powers at their disposal to disrupt prosecution especially if itβs federal. Putting trump to the side, what does this ruling mean to us as citizens?
