You can pay someone off and it not be a crime but if you do it to influence an election and/or to pay less/no taxes on that money then it turns out those are crimes in most states.
The prosecutors are going to try to prove to a jury of Trumps peers that he did it for election reasons not for hiding it from Melania.
And after Pecker’s testimony it seems pretty clear it was for the election.
Side note: Any American citizen can and should do their duty as a juror. From soldiers to lawyers all citizens have an obligation to do their civic duties. Wouldn’t you want some one with the intelligence to pass the bar and know the law well to sit in on this case?

The jury has heard of the "Illegal Payments" in the opening of the trial. I do not know if they were referred to this way by prosecution or the judges instruction. If it is instruction it is improper, and if it was the prosecution that made this remark, it should be objected to by the defense council. The payments are not illegal and certainly not criminal. It is my understanding that the falsification of the corporate records must be made to cover up a crime and there is no crime. As it is now, the jury thinks the payments are illegal, and that is not the case at all.
