The Supreme Court should never, ever, ever be political. Judges shouldn’t even have party names attached to them. Things are constitutional or they are not, full stop. Good on the judges that describe themselves as “constitutionalists” (I think I heard Gorsuch use that term?). Shame on every judge that looks at the Supreme Court as a platform for making laws. The Supreme Court is supposed to be the fail safe when the rest of the system fails.

The supreme court has basically asked the lower courts to toss out the cases against Trump for them. They would have tossed it but just wanted to avoid controversy. So they delegated to the lower court to wind up the ruling.
